NOTICE OF ADOPTION OF RESOLUTION SUBMITTED TO AUTHORIZED REFERENDENUM NOTICE IS HEREBY GIVEN of the adoption by the City Council of the City of Fayette, Seneca County, New York, at a meeting held on September 29, 2021, of Local Law No. 2 of 2021 titled, “A LOCAL LAW TO BE APPLIED TO THE NEW YOEK STATE CANNABIS CONTROL BOARD, EXEMPTION FROM THE ISSUE OF RETAIL DISPENSARY AND ON-SITE CONSUMPTION LICENSES UNDER THE ‘SECTION 4 OF THE NEW YORK AND ON-SITE CONSUMPTION LAW OF FAYETTE ”, and which local law is subject to a permissive referendum as provided in paragraph 24 of the New York State Municipal Self-Government Act . Local law n ° 2 of 2021 is as follows:

WHEREAS the local bill # 2 of 2021 was duly tabled before the municipal council of Fayette and a notice of public hearing was published in the official journal of the City and WHEREAS this public hearing took place on September 29, 2021 at 4 p.m. and all those present who had the opportunity to be heard on this subject, and WHEREAS the municipal council of the Town of Fayette having determined that it is in the interest of the Town that the Local Law # 2 of 2021 be passed subject to a permissive referendum, Now, therefore, BE IT RESOLVED that Local Law # 2, 2021, a local law to be requested from the Cannabis Control Board of the New York State, exemption from on-site retail and consumer licensing

Pursuant to section 4 of the New York State Cannabis Act in the City of Fayette, “is enacted as follows: SECTION ONE: Notwithstanding the provisions of Section 4 of the Cannabis Act of New York City of Fayette requests that the new York Cannabis Control Board prohibits the establishment of retail cannabis licensing dispensaries and the issuance of on-site cannabis consumption licenses in the city of Fayette, New York, in except for the request of the part of the city which is in the village of Waterloo SECTION TWO: This local law is subject to a permissive referendum and will come into force forty-five days after its adoption by the municipal council of Fayette, unless within forty-five days of its adoption, a petition is filed with the clerk to protest against this local law., Signed and authenticated as required under §24 of the Municipal Self-Government Act of State of Ne w York, after which it will come into force after an affirmative majority vote in the city. Voters in the city have voted in a special election to be held in accordance with the Municipal Self-Government Act. and be it further RESOLVED that the Clerk immediately cause a copy of the local law to be published in the city’s official gazette with notice of the date of its promulgation by council and notice that such promulgation is subject to a permissive referendum in accordance with in §24 of the New York State Municipal Self-Government Act. and it is further RESOLVED that the municipal clerk cause a copy of said local law to be deposited with the secretary of
